Our firm, Parikh & Prasad, PC recently filed and obtained an approval for EB-1A Petition (Alien of Extraordinary Ability) on behalf of a Nephrologist. EB-1A visa classification is available to individuals who have extraordinary ability in the field of science, arts, education, business or athletics. To obtain EB-1A classification an individual must demonstrate that he (or she) has sustained national or international acclaim and that his (or her) achievements have been recognized in the field of expertise, indicating that he (or she) is amongst a small percentage who has risen to the very top of their field of endeavor.Initially, our client was hesitant whether to even pursue and seek an EB-1A classification, however, after the initial consultation with our firm’s attorneys, the client became sure that EB-1A is a good option. The client had very few publications based on client’s academic research in the subspecialty field of Nephrology and client’s work was not widely cited (fewer than 25 citations). Our firm’s attorneys meticulously worked with the client in drafting and obtaining reference letters and related supporting evidence. The petition was filed with the USCIS Texas Service Center. Shortly, thereafter USCIS issued a Request for Evidence (RFE) asking for additional evidence. Once again our firm’s attorneys quickly analyzed the RFE, compiled the sought evidence, and presented a compelling argument for the approval of the EB-1A petition. USCIS approved the petition. The entire case from filing to approval took around 40 days.
